Program Summary

Many Social Security disability claims fail not because of weak facts, but because key SSA policies are overlooked. This CLE examines underutilized regulations, POMS provisions, and emergency policy updates that can significantly strengthen disability advocacy. Attorneys will learn how to leverage SSA’s own internal guidance to challenge flawed vocational evidence, identify favorable medical-vocational profiles, and analyze past work properly. The session focuses on practical litigation strategies that improve outcomes at both the administrative and hearing levels. Participants will leave with concrete techniques for building stronger records and arguments.

Eligible for up to 1 CLE Credit Hour.

This session was originally submitted for CLE as a live, in-person presentation and a live webcast for the 2026 Spring National Conference and may be eligible for self-study credit. Each state handles self-study credit differently; for questions, please consult your State Bar Association.

Recorded Friday, April 24, 2026.

Key topics to be discussed:

  • Administrative waivers and procedural tolerance
Learn how SSA’s internal waiver provisions can prevent technical errors from derailing claims and allow attorneys to preserve issues for adjudication.
  • Composite jobs and past relevant work analysis
Understand how composite job classification can change step-four findings and help defeat unsupported “not disabled” determinations.
  • Medical-Vocational profiles and borderline age applications
Explore how special vocational profiles and borderline age rules can shift outcomes under the Medical-Vocational Guidelines.
  • Challenging obsolete vocational evidence
Examine recent SSA emergency guidance restricting outdated occupational data and how to challenge unreliable vocational testimony.

Agenda

I. Using SSA’s Own Playbook: Underutilized Policies That Strengthen Disability Claims | 8:30am – 9:45am

This session by Ed Olson and Tom Krause reveals lesser known Social Security policies, including administrative waiver tolerance; past relevant work analysis; composite jobs and workplace accommodations; medical-vocational profiles for arduous work histories and borderline age applications; and recent emergency messages restricting use of obsolete occupations in “not disabled” determinations; and continuing disability review patterns. The materials emphasize practical POMS applications and regulatory updates that disability attorneys can use to strengthen advocacy and better navigate the Social Security system.
