Program Summary

Kids’ privacy is an area of increased legislative and regulatory attention. The Children’s Online Privacy Protection Act (COPPA), which relates to the collection, use, and disclosure of personal information from children under 13, has been in place for a generation. The Federal Trade Commission (FTC) actively enforces COPPA and the FTC is in the process of updating the COPPA Rule. State legislatures are tackling online youth privacy and safety, although courts have been quick to stop these efforts, often on First Amendment grounds. In addition, Congress has renewed its attention on a variety of proposals, including COPPA 2.0 (which would expand kids’ online privacy protections), and the Kids Online Safety Act (which would require online platforms to take certain actions to protect minors). As a result, businesses are on high alert, wondering what this means for them.

Laura Riposo VanDruff is Office Manager Partner of Kelley Drye’s Washington, D.C. office and former Chair of the firm’s Advertising and Marketing practice group. Laura counsels and defends companies on consumer privacy, data security, advertising, and consumer protection matters.

During her near-decade of service in the Federal Trade Commission’s Bureau of Consumer Protection, including as Assistant Director in the Division of Privacy and Identity Protection, Laura handled matters related to legal violations involving the privacy and security of consumer information. She is a subject matter expert on the Children’s Online Privacy Protection Act (COPPA) and regularly advises clients on kids’ privacy issues.

Laura is a vice chair of the American Bar Association’s Antitrust Law Section’s Committee on Privacy and Information Security and a past lecturer at the University of Virginia School of Law.
