Program Summary

For attorneys involved in elder law, special needs planning and estate planning, Medicaid services can be a critical and necessary component of planning for their clients. This CLE event will provide an explanation of the various Medicaid programs available for individuals aged 65 or older and individuals with physical or developmental disabilities between the ages of 18-64 years old, who meet a nursing facility level of care but wish to remain outside of the institutional setting.

Key topics to be discussed:

  • Asset and resource eligibility for institutional services (nursing home) and community-based home care
  • The differences between spend-down and income-cap states in managing excess income
  • Transfer penalty determination in New York and other states
  • An overview of exempt transfer options
  • Crisis planning (promissory notes)
  • New York Waiver programs and the Consumer Directed Personal Assistance Program
