Program Summary

With the inclusion of SSR 24-3p, representatives have been given an additional burden to check the power of vocational experts. While this may seem like more work, in reality this creates a higher ceiling for success if the work is put into the process. In this specific instance, there are vocational experts within the Social Security Administration that utilize only SOC codes for providing significant numbers in the national economy and disguise this practice by hiding behind representative DOT occupations from the ONET crosswalk. Not only is this process duplicitous, it violates administration policy when looked through a closer lens. With this presentation, representatives will be able to identify vocational experts who are inflating their numbers through the use of SOC codes instead of relying upon data for each individual DOT occupation and eliminate problematic vocational experts that contribute to wrongful denials of benefits.

Key topics to be discussed:

  • SSR 24-3p actually empowers representatives to fight against VEs by allowing additional insight into their methods
  • There is a trend of experienced and inexperienced VEs, and SSR 24-3p makes it easier to identify which is which
  • SOC codes cannot be used to identify "other jobs" according to regulations
  • Catching and removing the inexperienced VEs to preserve the case

This course is co-sponsored with myLawCLE.
